Welcome to Siply. These Terms of Service (“Terms”) govern your access to and use of the Siply mobile application, website, and related services (collectively, the “Service”), operated by Layout Media LLC (“we”, “us”, or “our”).

By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Who We Are

Siply is a hydration tracking application designed to help individuals monitor their daily water intake. Our philosophy is simple: no ads, no gimmicks, just water. We provide a clean and minimal user experience focused solely on hydration wellness.

2. Eligibility

By using Siply, you confirm that:
• You are at least 13 years old (or older if required by local law),
• You have the legal capacity to enter into these Terms, and
• You are not barred from using the Service under any applicable law.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

Creating an account is optional but enables syncing your data across devices. You agree to provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and agree not to share your login information with others.

We are not liable for any unauthorized access to your account caused by your failure to secure your credentials.

4. Acceptable Use

You agree not to:
• Use the Service for any unlawful or harmful purpose;
• Attempt to reverse engineer, decompile, or extract source code from the app;
• Access or tamper with non-public areas of the app or systems;
• Disrupt or interfere with other users or servers.

Violation of these guidelines may result in immediate termination of your access.

5. Data & Privacy

Your privacy matters to us. Siply does not sell or monetize your data. All user water intake data is stored securely in our backend, powered by Firebase.

We do not collect or store user-uploaded images used for our scanning feature. All image processing related to volume estimation is performed locally on your device using our custom model, NVA-1.

6. NVA-1 Feature Disclaimer

Siply includes an optional feature that allows users to estimate water volume using the camera and our proprietary machine learning model, Nova (NVA-1). This feature is still in development and may produce inaccurate results. It is provided for informational purposes only and should not be used in place of precise measurements.

Use of this feature is entirely at your own discretion.

7. Intellectual Property

All content, trademarks, logos, and designs available through the Service are owned by Layout Media LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works without our express permission.

You retain ownership of the data you input into Siply. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing the Service.

8. Modifications to the Service

We may modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We are not liable to you or any third party for any modification or discontinuance.

You may stop using Siply at any time. We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the integrity of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee the accuracy of volume estimations, hydration recommendations, or analytics provided by the Service.

11. Limitation of Liability

To the fullest extent permitted by law, Layout Media LLC shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or relating to your use of the Service.

In no event shall our total liability exceed the amount you paid to us, if any, in the past 12 months for the Service.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any disputes will be resolved exclusively in the courts located in Sacramento County, California.

We reserve the right to update these Terms at any time. Changes will be posted to https://drinksiply.com/terms-of-service and take effect immediately upon posting. Continued use of the Service after changes are posted constitutes your acceptance.
